1. Agreement to Terms

By accessing or using Vaine ("the Service", "the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all users, including visitors, registered users, and paying subscribers.

Vaine is operated by Mark Taylor ("we", "us", "our"), a sole proprietor registered in South Africa. Contact: hello@vaine.co.

2. Description of Service

Vaine is a B2B lead generation platform that allows registered users to search for and obtain verified business contact data — including email addresses, phone numbers, and professional details — sourced from publicly available records and third-party data providers.

The Service includes:

  • AI-assisted lead search ("hunts") using Apollo.io data
  • Contact enrichment (email and phone verification)
  • A personal lead vault (secure data storage)
  • CSV export of collected leads

3. Subscription and Payment

Access to the Service requires a paid subscription. Subscriptions are billed monthly in South African Rand (ZAR) via Paystack. Subscription tiers and prices are displayed on our pricing page. Prices may change with 30 days' notice.

By subscribing, you authorise us to charge your selected payment method on a recurring monthly basis. You are responsible for keeping your payment information current.

4. Acceptable Use

You agree to use the Service only for lawful B2B sales and marketing purposes. You must not:

  • Use contact data to send unsolicited spam or conduct phishing
  • Resell, redistribute, or sublicense lead data to third parties without our written consent
  • Use the Service in any way that violates POPIA (Protection of Personal Information Act) or applicable data protection law
  • Attempt to scrape, reverse-engineer, or circumvent platform security
  • Use the Service to contact individuals who have opted out of marketing communications

5. Data and Privacy

Contact data provided by Vaine is sourced from publicly available professional records and licensed data providers. You are responsible for using this data in compliance with POPIA and any other applicable legislation. You must provide a clear opt-out mechanism in all communications sent to leads.

Our handling of your personal information is governed by our Privacy Policy.

6. Intellectual Property

The Vaine platform, including its software, design, and branding, is the exclusive property of Vaine. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes. You do not acquire any ownership rights by using the Service.

7. Disclaimers

The Service is provided "as is". We do not guarantee that all contact data is accurate, complete, or current. Data quality depends on third-party providers and is subject to change. We are not liable for the outcome of any sales or marketing activity conducted using leads obtained through Vaine.

8. Limitation of Liability

To the maximum extent permitted by law, Vaine's total liability to you for any claim arising from use of the Service shall not exceed the total subscription fees paid by you in the 3 months preceding the claim. We are not liable for any indirect, consequential, or incidental damages.

9. Termination

We reserve the right to suspend or terminate your account without notice if you breach these Terms. You may cancel your subscription at any time. Upon cancellation, your access continues until the end of the current billing period. See our Refund Policy for details.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of South Africa.

11. Changes to Terms

We may update these Terms at any time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
